This Privacy Policy describes how we collect, use and protect your personal data through the website www.bendis.es and the BENDIS mobile app, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

2. PERSONAL DATA WE COLLECT

We may collect the following personal data:

Data provided directly by the user:

  • First and last name
  • Shipping and billing address
  • Email address
  • Phone number
  • Payment details (handled securely by specialized third parties)
  • Order history and purchase preferences

Data collected automatically:

  • IP address and device data
  • Pages visited, browsing time and behavior on the website
  • Cookies and similar technologies (see section 8)

The BENDIS mobile app does not collect any of this data. How it works is described in section 12.

3. PURPOSES OF PROCESSING

We process your personal data for the following purposes:

  • Order management: processing, shipping and tracking your purchases.
  • Customer service: answering inquiries and handling returns and incidents.
  • Subscription management: managing your subscription to the recurring service if you have signed up for it.
  • Marketing communications: if you have given your consent, sending you BENDIS news, offers and promotions.
  • Website improvement: analyzing browsing behavior to optimize the user experience.
  • Compliance with legal obligations: invoicing, accounting and other applicable legal obligations.

4. LEGAL BASIS FOR PROCESSING

The processing of your data is based on:

  • Performance of a contract: when you make a purchase or sign up for a subscription.
  • Consent: for sending marketing communications and using non-essential cookies.
  • Legitimate interest: for fraud prevention and improving our services.
  • Legal obligation: for compliance with tax and accounting regulations.

5. RETENTION PERIOD

We keep your data for as long as necessary for the purpose for which it was collected:

  • Order and customer data: for the duration of the business relationship and up to 5 years afterwards for tax and legal obligations.
  • Data for marketing communications: until you withdraw your consent.
  • Browsing data and cookies: as indicated in the Cookie Policy.

6. DATA RECIPIENTS

We may share your data with third parties in the following cases:

  • Shipping and logistics companies: to deliver your orders.
  • Payment gateways: to process payments securely (we do not store card details).
  • Technology platforms: such as Shopify (ecommerce platform), email marketing and web analytics tools, with which we have data processing agreements in place.

We do not sell or transfer your data to third parties for commercial purposes.

7. INTERNATIONAL TRANSFERS

Some of our technology providers (such as Shopify Inc., based in Canada and the United States) may involve international data transfers. These transfers are carried out with appropriate safeguards under the GDPR, including standard contractual clauses approved by the European Commission.

The BENDIS mobile app does not carry out data transfers of any kind, whether domestic or international.

8. COOKIES

We use our own and third-party cookies to improve your browsing experience, analyze traffic and offer personalized content.

Essential cookies are necessary for the website to function and do not require consent. The use of non-essential cookies (analytics, marketing) requires your explicit consent. Browsing without accepting cookies does not result in them being installed.

You can manage your cookie preferences at any time from the cookie banner or from your browser settings.

The BENDIS mobile app does not use cookies or equivalent tracking technologies.

9. USER RIGHTS

Under the GDPR and the LOPDGDD, you have the right to:

  • Access: know what data we hold about you.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure ("right to be forgotten"): request the deletion of your data when it is no longer necessary.
  • Objection: object to the processing of your data, especially for marketing purposes.
  • Restriction: request that we restrict the processing of your data in certain circumstances.
  • Portability: receive your data in a structured, commonly used format.
  • Withdrawal of consent: at any time, without affecting the lawfulness of prior processing.

10. DATA SECURITY

We apply appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, alteration or accidental disclosure. Our website uses SSL encryption and we only work with providers that meet the security standards required by the GDPR.

11. MINORS

Our services are not intended for children under 14. We do not knowingly collect personal data from minors. If we discover that we have collected data from a minor without parental consent, we will delete it immediately.

The BENDIS mobile app is designed for professional use in venues and businesses and is not intended for minors.

12. BENDIS MOBILE APP

This section explains how the BENDIS mobile app, which lets you control BENDIS scent nebulizers via Bluetooth, handles your data. It works differently from the online store, which is why it is described separately.

12.1. The app does not collect personal data

The app runs entirely on your phone. It requires no registration or user account, does not connect to the internet and does not send any information to BENDIS or to third parties. There are no servers, databases, analytics tools, advertising or tracking technologies associated with the app.

12.2. Information stored on your device

The app stores the following information in your own phone's memory, and only there:

  • The name you give each nebulizer and its Bluetooth identifier.
  • The selected device model.
  • The configured diffusion intensity and schedules.
  • The milliliters of fragrance you enter when refilling the tank, used to estimate the remaining level.
  • Your name and the name of your business, if you choose to enter them.
  • The four-digit PIN code that gives access to the app.

This information never leaves the device. When you uninstall the app it is deleted along with it, and BENDIS keeps no copy.

12.3. Bluetooth permission

The app communicates with the nebulizers via Bluetooth Low Energy, the only available means of finding, turning on and programming them. Without this permission the app cannot perform its function.

Bluetooth is used only while the app is open in the foreground. The app does not run in the background or establish connections on its own.

12.4. Location permission

On devices running Android 11 or earlier, the operating system requires location permission in order to detect nearby Bluetooth devices. This is a requirement imposed by Android, not something the app needs.

The app never accesses, stores or transmits your location. On devices running Android 12 or later, the app declares to the operating system that it will not use Bluetooth to infer the user's location (the neverForLocation flag), which is why location permission is not requested at all on those devices.

12.5. Exercising your rights

Since the app does not collect or keep personal data outside your own device, BENDIS holds no information to access, rectify or erase in connection with its use. To delete the information stored locally, simply uninstall the app.

13. CHANGES TO THIS POLICY

BENDIS reserves the right to modify this Privacy Policy at any time to adapt it to legislative or service changes. The updated version will always be available on this page with the date of the last update.
